I understand that all employment with Fibertel is on an at-will-basis, which means that the employment relationship may be terminated by myself, Fibertel, or clients of FiberTel with or without cause, with or without reason, and with or without notice. I further understand that there is no contract for employment, express or implied, As consideration for employment, I agree that any claim, dispute, or controversy (including but not limited to, any and all claims of discrimination and harassment) which otherwise require or allow resort to any court or other governmental dispute resolution forum between an employee and Fibertel and/or Fibertel clients (or their owners, officers, managers, employees, agents, and other parties affiliated with employee benefit and health plans), or between an employee and any other person or entity for whom the employee is required to perform services pursuant to my employment with Fibertel and/or Fibertel clients, whether based on tort, contract, statutory, or equitable law, or otherwise (with the sole exception of claims arising under the National Labor Relations Act which are brought before the National Labor Relations Board, claims for medical and disability benefits under the Utah Worker’s Compensation Act, and the Department of Workforce Services claims), shall be submitted to and determined exclusively by biding arbitration pursuant to the Federal Arbitration Act, in conformity with the procedures of the American arbitration Association under its National Rules for the Resolution of Employment Disputes and judgment based upon the decision or award by the arbitrator(s) in such arbitration may be entered in any court having jurisdiction thereof.
